Repeat After Me, Cyprus Is (Was) Not a Tax Haven ? naked capitalism

Cyprus is over as an international banking center, which the Financial Times reports was one of Berlin?s objectives for its rescue. However, the business press (and yours truly following them) has referred to Cyprus as a tax haven. That description is part of the PR campaign to justify punishing the island.

There?s been a general meme in many of the ?Cyprus comments? that intimate if not outright discriminate Cyprus? Financial Center status as a bastion of money laundering and international corruption. This is then used to reason a justification for why Cyprus is simply getting its comeuppance. To be clear, I am neither an apologist for Cyprus?s present predicament nor a belligerent activist against tax havens, such as the Cayman Islands or Isle of Man.

Cyprus is a low-tax jurisdiction, not a tax haven. Cyprus is on the OECD?s ?white list? of jurisdictions complying with the global standard for tax co-operation and exchange of information. Its fiscal and regulatory regimes are fully aligned with the acquis communautaire and the Code of Conduct for Business Taxation of the EU and the requirements of the OECD, the FATF, and the FSF. However the Cayman Islands? maintains only 12 bilateral tax information arrangements; and The Isle of Man, 14. Cyprus an arrangement with all of its OECD bilateral (double-taxation treaty) partners ? 46 fully, 6 being ratified.

Within these 52 countries, Cyprus has double-taxation treaties with about every country in the EU, and includes China, the US, Russia and, practically, every Middle East country. All the double-taxation treaties concluded by Cyprus were drafted on the basis of the Organization of Economic Co-operation and Development (OECD) model treaty.

The primary objectives being:

1.) Clarify and determine the taxing rights of each contracting state;
2.) Reduce or avoid the impact of international juridical double taxation; and
3.) Introduce anti-avoidance provisions and mechanisms to prevent tax evasion.

Cyprus is an exemplar of an OECD ?low-tax jurisdiction? country (one that the US constantly, it seems, want to emulate) since it combines a low-tax regime with an extensive network of double-taxation treaties (which neither the Cayman?s nor the Isle of Man does).

One of the most powerful ?tools? used by entities such as the Cayman Island and the Isle of Man is the (internationally accepted) ?Passive Dividend Rules? ? where the foreign participation tax exemption applies to foreign dividends onshore.

?Passive Dividend Rules? apply, typically, when (the numbers differ):
1.) Investment income, direct or indirect, is less than (say) ?50 percent? of the paying company?s activities;
2.) The foreign tax burden on the income of the paying company is not substantially lower than the tax burden on the resident parent company (the shell).
3.) The taxable funds are held by the company within jurisdiction for a period of time (say, 50 days).

So, of course tax avoidance funds/profits are washed through the Cayman?s and Isle of Mann which ?facilitates? (in too many ways) nominally, declared high company tax and with zero resident tax and allow ?bed and breakfasting of funds? (period end off-shoring at night, back in the morning).

However, Cyprus? ?The foreign Participation Tax? almost wholly mollifies (in that there is a substantive article of tax) the ?tax haven-ish? parts of the ?Passive Dividend Rules?, which it applies to any capital gains realized by a Cyprus-resident company on a sale of shares in a foreign subsidiary, regardless. And to further button it down, ?Investment income? is defined as any income which is not derived or does not accrue from any business, employment, pension, or annuity paid by reason or in connection with past employment. None of which is the case with ?The foreign Participation Tax? used in the Cayman?s and Isle of Man.

Cyprus? ?Foreign Participation Tax? and use of Passive Dividend Rules are, explicitly, intended to prevent non-resident companies, over which domestic taxpayers have a controlling or substantial interest, from converting passive income into exempt dividend income, while adhering to the principle that anti-avoidance measures should be used only to maintain the equity and neutrality of national and international tax laws.

Additionally, Cyprus? targets only passive income not derived from genuine business activities. They do not extend to activities such as production, normal rendering of services, or trading by companies engaged in real industrial or commercial activity, and they are not applicable to countries in which the taxation is comparable to that of the country of residence of the taxpayer; it?s not until the subsidiaries start to distribute dividends, that any exemptions become available?. Again, in tax havens, passive dividends are, typically exempt from tax before distribution.

I am sure there are many tax accountants who could, no doubt, find loophole and issues with Cyprus? tax methodology (or this summary); there always will be ? it?s their job. But, the point is intent, and Cyprus intends it not too easy to be seen or used as a tax haven; other Sovereigns boast quite the opposite.

As mentioned before (in another post), I am sure that Cyprus has its own fair share of Banking, AML, Mafia, Drug Smugglers, non-paying dog license owner?s etc. issues. You may not like tax treaties, or tax havens or even Cyprus itself (fine let?s discuss that in general terms for all countries), but, to equate the blatant money laundering and tax evasion of the Cayman?s, Isle of Man or Chinese pawn shops that Romney, GE, Apple, Siemens, and their directors have so effectively used to evade tax, to the vastly more transparent inter-mediation of Cyprus Banks is ill-informed and abusive.

Sequestration forces NASA to hold up educational and outreach efforts

NASA says the tweets will continue despite a "pause" in educational and public outreach initiatives.

NASA is putting the brakes on its educational and public outreach efforts, due to the continuing standoff over the federal budget and the resulting sequestration of the agency's funds.

The cutbacks in NASA's activities, including social-media initiatives, were outlined on Friday in a pair of memos from NASA Headquarters in Washington. The independent SpaceRef website published both memos, including one that ordered a suspension and another that provided additional instructions for NASA's Communication Coordinating Council.

Automatic spending cuts are taking effect, at NASA and many other federal agencies, as the result of the failure by the White House and Congress to agree on a budget deal. Last month, NASA Administrator Charles Bolden told lawmakers that sequestration would reduce NASA's overall budget from the $17.8 billion that Congress approved last year to $16.9 billion.


The space agency already has cut back on travel and training expenses. As a result, some of the space agency's scientists and executives had to pass up this week's Lunar and Planetary Science Conference in Texas. The new directives extend the cutbacks to online, multimedia and social-media initiatives as well as publications.

Operational websites and social-media accounts were excluded from the suspension, however?? which means existing Twitter accounts, including @NASA and @MarsCuriosity, can stay in business. NASA has rapidly expanded its online presence in the past couple of years, winning recognition from the Emmys, the?Shorty Awards?and?the Webby Awards. Just this month, the Mars Curiosity mission's social-media team won the South by Southwest Interactive Award for best social-media campaign.?

Waivers were also granted for mission announcements, media events and products, breaking-news activities and responses to media inquiries. In an emailed response to NBC News' inquiry, NASA spokesman Bob Jacobs said additional guidance would be issued next week, addressing areas that would be exempt from the suspension.

"It's important to point out that it's a suspension, not a cancellation," Jacobs wrote. "The agency's budget for the fiscal year is more that $1 billion below the original request. We are taking prudent steps to ensure the resources expended on outreach activities are done so wisely.

"Mission activities and much of the existing news and information dissemination is not likely to be impacted, including our successful social media efforts," he said. "However, it is important in this constrained fiscal environment to pause and assess how the money is being spent on a wide variety of outreach activities, many of which are funded by independent projects and programs. We are not canceling anything yet. We are being financially responsible by pausing long enough to review activities before they go forward."

Update for 9 p.m. ET March 23: Folks have started a petition on the White House's "We the People" website, calling for a repeal of the sequestration cuts for education and public outreach. Although the sentiment is admirable, NASA's hands (and the White House's hands) may be tied by the rules that govern sequestration. It's important to note that all of the space agency's activities have to be cut back by the same percentage. It's just that in the case of education and public outreach, the memos that address the process for starting the cuts have now been made public.?

That being said, signing a White House petition is a great way to make your opinion known, and so is writing or calling your representatives in Congress.

    I have made an application that connects to an IMAP mail server. When I click the connect button my app just freezes up. No errors or anything. It just freezes. This has happened before when trying to use MySQL servers. All my apps that have to connect to servers freeze when they connect. I know it's working fine because when I type in incorrect info, I get an error and it doesn't freeze, only when it actually tries to connect. If you want my code, here it is:

    I would do something with the connection, such as reading an email, and close the connection. At least this would show that the connection is available.

    I did a Try statement and the exception was a message box that said "Could not connect". After clicking connect and waiting about three minutes for something to happen, i got the error message. I tried several different ports but kept getting the same message after a few minutes. Maybe it's the IMAP reference thats not working. It still freezes on MySQL apps though.

    Reconnecting the Church: Networks - Their Value in Strategy

    Networks are the invisible webs of relationships that link people together. Simply stated, they are people talking to each other, sharing ideas, information and resources. Traditionally, networks have been oriented to kinship, neighborhood, and friendship ties. In a broader urban context, particularly in complex culture, however, they can forge broad coalitions of people and organizations to accomplish specific tasks which are in the interests of all involved. Some examples of where networking is done are families, mutual friends, conferences, private clubs, social media, travel, parties, meetings, and workshops.

    There are different types of networks. Some exist naturally (family, colleagues, or friendships), others are organized formally (prestige clubs, coops, etc.), and yet others are brought together to accomplish one specific task (election campaign).

    Ray Bakke points to three kinds of networks: those based on kinship, on geography, and on vocation. To these we can add networks based on common interest and shared information. Each of these can serve as a means of evangelistic outreach.

    Kinship / Workplace / Friendship Networks

    Friendships perform significant functions in all societies. In any setting, next to family ties, they are often the closest relationships people have. Depending on where you live, your significant network will probably be made up of family, friends or colleagues.

    It is reported that after two or three years, the average new Christian will have very few friendships outside the church. Virtually all of their unsaved friends will either have left them or been left behind. Unfortunately, in an effort to build community or out of fear of the world around them, many churches encourage members to form their friendships only inside the congregation. If this happens, those church members will have almost no networks they can use to witness to the lost.

    Friendship networks in the lives of new Christians can be important for further evangelism and discipleship formation. Campus Crusade for Christ, for example, has used events in the homes and apartments of new believers for new Christians to witness. A new Christian would invite his or her friends to a party, and toward the end would give his or her testimony. A time for Q&A and an opportunity for deeper and more personal conversation about salvation can also be planned. If one of the friends receives Christ, the process is repeated.

    Common-Interest Networks

    Other ways to use networks in the church would be to organize small groups, special interest groups that nurture Christians in their particular walks of life, or common need groups of all kinds. All can be utilized to bring others to faith and spiritual maturity. An example of networks in the community would be Christian business associations, where Christians in the market-place gather in a neutral space and invite their non-Christian friends. The program is most often built around issues of interest to people in the business world. Similarly, Christian doctors, nurses, academicians, politicians, construction workers, and other specialists reach out to those in their respective vocations.

    Special interest groups go beyond vocational associations. Single parents, young singles, old people, parents whose children are on drugs, women whose husbands are abusive or alcoholics?anyone who needs Christian friends who understand and can help them through their particular trials. Churches need to be sensitive to special needs, and stand by all with love and friendship.

    One group has been particularly responsive historically and currently, namely, students. Students are exploring new ideas and so are often more open to hearing the gospel than when they become established in their cultures and careers. Student ministries in high schools and universities have not only won many to Christ but also produced many strong leaders for the church.

    Networks for Task Completion

    In order to be a servant to its community, the church also needs to network with as many institutions and organizations as possible. Information about needs in the community circulates in existing networks, and if the church is plugged in, and has resources to help, it can offer its assistance. Once viable networks have been established, it is important to encourage church members to get plugged into those organizations.

    If we are serious about reconnecting the church and its witness to the community, we must begin planning ministry that happens outside the church building. We must also begin to act on the fact that loving service to others, in any form, is a witness. We need to minister because it is the right thing to do, not because it will fill our church?the sowing and reaping principle. Jesus made this abundantly clear in Matthew 25. Befriending someone who does not yet know Christ is ministry. Listening to a colleague?s personal problems without judging his or her lifestyle is ministry.

    Ministry in the complex culture, using its networks, is spreading the gospel message. At the same time, it is one way the Church can reconnect itself to its context, the community in which it serves. The reconnecting church is a church that finds a way to be a servant.

    More than 6000 new units in downtown - Inside Real Estate News

    During the past five years, more than 6,000 residential units were added or are under construction in downtown Denver.

    That is one of the key findings in the release of a map pinpointing developments in downtown that was released today by the Downtown?Denver Partnership.

    The Downtown Denver Development Map was released at the partnership?s monthly member forum, titled: Downtown Development Takes Off: Creating a World Class City.

    The map is intended for developers, investors and brokers interested in downtown Denver.

    The map illustrates the robust private and public investments that have occurred in Denver?s urban core over the past five years, as well as the 20 developments currently under construction. The map lists 72 public and private sector developments or infrastructure projects in Downtown Denver.

    The development map, which highlights key investments in the Downtown community, was presented by the?Kiewit Building Group and published by the Downtown Denver Partnership, with the support of the Downtown Denver Business Improvement District.

    ?We have seen a great concentration of development in the center city over the past five years signaling ongoing investment in downtown,? said Tami Door, president and CEO of the Downtown Denver Partnership.

    ?Highlighting these developments in this unique development map allows us to tell the story of growth and expansion in the urban center and share with developers and business leaders in order to continue those investments in the future,? she added.

    In addition to mapping developments, the map reports on several key facts about Downtown Denver developments over the last five years:

    • ?6,061 residential units added or under construction.
    • 2.36 million square feet of office space added or under construction.
    • 2,190 hotel rooms added or under construction.
    • 42 percent of projects were residential.
    • 20 projects listed on the map are currently under construction, seven of which are in the Union Station area.
